Terms of Service

Welcome to Who's Hungry? (“Who's Hungry,” “we,” “us,” or “our”), a social dining app that helps people make real-life restaurant plans with friends and like-minded people. These Terms of Service (“Terms”) are a legal agreement between you and Who's Hungry and govern your use of the Who's Hungry mobile app, our website at whoshungry.com, and related services (together, the “Services”).

By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility & Invite Access

You must be at least 13 years old to use the Services, and you must be old enough to form a binding contract in your jurisdiction. Some features are restricted to adults: connecting with new people you don't already know (including the “+1” experience) requires you to be 18 or older, and may require identity and age verification.

Who's Hungry is currently invite-only and rolling out market by market. Access may require a valid invite, and invites are personal to you. You agree not to sell, transfer, or abuse invites or invite codes.

2. Your Account

You sign in using Apple or Google—we do not use passwords. You are responsible for the activity on your account and for keeping your sign-in method secure. You agree to provide accurate information (including your name, and where applicable your date of birth) and to keep it current. You may not impersonate anyone, create an account for someone else without permission, or use the Services if we have previously banned you.

3. The Service

Who's Hungry lets you create and join dining plans—including private plans, shared tables, and “+1” connections—chat within plans, build shared memories with photos and videos, save restaurants, and discover plans, tables, and deals near you. Features evolve over time, and we may add, change, or remove features at our discretion.

Plans are commitments to real people. We expect you to show up for plans you commit to, communicate if circumstances change, and treat hosts, guests, and restaurant staff with respect.

4. Acceptable Use

You agree not to:

  • Harass, threaten, harm, deceive, or stalk other users, or use the Services to meet people for unlawful purposes;
  • Post or share content that is illegal, hateful, harassing, sexually explicit, violent, or that infringes others' rights;
  • Impersonate others or misrepresent your identity or age;
  • Use the Services for spam, solicitation, scraping, or unauthorized commercial purposes;
  • Attempt to access accounts or data that aren't yours, or probe, disrupt, or reverse-engineer the Services; or
  • Violate any applicable law or these Terms.

You can block users and report content or behavior in the app. We may remove content, limit features, or suspend or terminate accounts that violate these Terms or threaten the safety of our community.

5. Meeting People & Safety

Who's Hungry helps you meet people and dine in the real world. We do not conduct criminal background checks and, aside from optional identity verification, we cannot confirm that users are who they say they are. You are solely responsible for your interactions with other users. Use good judgment—meet in public, tell someone where you're going, and put your safety first. Who's Hungry is not responsible for the conduct of any user, online or offline.

Who's Hungry offers optional “Advanced Discovery” filters that let you choose the kinds of people you'd like to meet for +1 and Shared Table plans, and lets you optionally share your own background, religion, and languages so others' filters can match you. Sharing this and using these filters is entirely optional and reflects personal social preference; this information is never shown on your profile and is used only internally to power discovery. You agree to use these features lawfully and not to harass, demean, or discriminate against any person. See our Privacy Policy for how this information is handled.

6. Your Content

You retain ownership of the photos, videos, messages, reviews, and other content you create (“Your Content”). By posting Your Content, you grant Who's Hungry a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute it solely to operate and improve the Services—for example, showing your memories to other participants in a plan. Content shared within a plan (such as messages or memories) may remain visible to other participants even after you leave or delete your account.

You are responsible for Your Content and represent that you have the rights to share it. We may remove content that violates these Terms.

7. Reservations & Restaurants

When you make a reservation, we hand off to third-party reservation partners such as OpenTable, Resy, or SevenRooms, whose own terms and policies apply. Restaurants are independent businesses. Who's Hungry does not operate restaurants and is not responsible for the food, service, availability, pricing, or any aspect of your dining experience.

8. Deals & Offers

Deals are offers created by participating restaurants and partners, and their specific terms (such as party-size requirements, timing, expiration, and availability) are set by the restaurant. A deal may unlock when a plan meets its conditions. Who's Hungry does not guarantee that any deal will be honored, and any dispute about a deal is between you and the restaurant.

9. Subscriptions & Billing

Who's Hungry offers optional paid subscriptions (such as WH+ and WH+ Prime). Subscriptions are sold through the Apple App Store and billed to your Apple account; we use RevenueCat to manage subscription status. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription in your App Store account settings. Except where required by law or App Store policy, payments are non-refundable. Benefits and pricing may change going forward.

10. Identity & Age Verification

Some features require optional identity and age verification, processed by our provider (Didit). If you choose to verify, you agree to provide accurate identity information. Misrepresenting your identity or age—especially to access adult-only features—is a violation of these Terms and may result in termination.

11. Our Intellectual Property

The Services, including the Who's Hungry name, logo, design, and software, are owned by Who's Hungry and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Services for their intended purpose. You may not copy, modify, distribute, or create derivative works from the Services without our permission.

12. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any plan, connection, deal, or reservation will meet your expectations.

13. Limitation of Liability

To the fullest extent permitted by law, Who's Hungry and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Services, your interactions with other users or restaurants, or any content. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100.

14. Indemnification

You agree to indemnify and hold harmless Who's Hungry from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Services, Your Content, your interactions with others, or your violation of these Terms or any law.

15. Termination

You may stop using the Services and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or if we discontinue the Services. Sections that by their nature should survive termination (such as content licenses already granted, disclaimers, and limitations of liability) will survive.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida and the United States, without regard to conflict-of-law rules. You agree that any dispute will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect means you accept the updated Terms.
